BERG vs OBAMA lawsuit being appealed to Supreme Court!
If this were happening on the Republican side it would be wall to wall 24x7 coverage. The fact is Phillip Berg, a Democrat, has been suing Barack Obama claiming that he is ineligible to become President of the United States because he was born in Kenya. The suit was recently thrown out of the Hawaii Supreme Court but Berg filed an emergency appeal with the Supreme Court!
(Lafayette Hill, Pennsylvania - 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama's lack of "qualifications" to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083. Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court. This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does? So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned. According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution. What happened to ‘...Government of the people, by the people, for the people,...' Abraham Lincoln in his Gettysburg Address 1863. We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States," Berg said.

What a coup for McCain if the Supreme Court rules in favor of Berg. Unfortunately I suspect the Supreme Court will not even hear the case; however if the Supreme Court days hear the case then things will get interesting. Even after this I would be surprised in favor of Berg.
On the other hand imagine the political chaos if the Supreme Court rules in favor of Berg and a majority of deluded deluded American voters elect BHO as President. This would be a major Constitutional Crisis the nation has never faced. Can the Supreme Court remove a sitting President because he is not eligible?
Probably such a decision would be rendered after the election which would not benefit McCain. Then we would be looking at a goof ball President Biden.
There are many things the Constitution does not cover because the founding fathers never anticipated this nonsense.
I wonder if Obama would step aside if the SCOTUS ruled him unable to run. What would they do with the ballots?

Actually the constitution does cover this. In layman's terms, if the supreme court ruled in Berg's favor before the election, it would require another dem convention. However, if it occurred after the election, and one party is disqualified, the election goes to the person who would have won the next most electoral votes
